1. Acceptance of Terms
By creating an account or using Nestora ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Service.
We may update these Terms from time to time. Material changes will be notified at least 14 days in advance. Continued use after the effective date constitutes acceptance.
2. Eligibility
To use Nestora, you must:
Be at least 18 years old
Be legally capable of forming a binding contract in your jurisdiction
Not have been previously banned from the Service
Provide accurate and truthful information in your profile
Comply with all applicable laws in your jurisdiction regarding assisted reproduction, sperm donation, and related matters

Nestora is a communication platform that allows individuals to discover and communicate with others who are interested in sperm donation, recipient arrangements, or co-parenting. The platform facilitates introductions only.
3.2 What Nestora Is NOT
Nestora is NOT a medical provider, fertility clinic, or healthcare service
Nestora is NOT a legal service and does not provide legal advice
Nestora is NOT a matchmaking guarantee or agency
Nestora does NOT verify the identity, health claims, or background of any user
Nestora does NOT facilitate, arrange, supervise, or participate in any donation, conception, or co-parenting arrangement
Nestora does NOT endorse, recommend, or certify any user
Nestora is NOT responsible for any outcomes of interactions between users
3.3 User Responsibility
All arrangements, agreements, and interactions between users occur outside of Nestora and are the sole responsibility of the individuals involved. Users are strongly advised to:
Seek independent legal counsel before entering any reproductive arrangement
Obtain professional medical advice and health screening
Understand and comply with all laws applicable in their jurisdiction
Use fertility clinics or medical professionals where appropriate
Not rely solely on information provided by other users
Exercise their own judgment regarding safety and suitability
4. Account and Registration
You must provide a valid phone number for verification
You are responsible for maintaining the security of your account
You must not create multiple accounts, share accounts, or impersonate others
You must keep your profile information reasonably current
We reserve the right to suspend or terminate accounts at our discretion
5. Acceptable Use
5.1 You Agree To
Treat all users with respect and dignity
Provide truthful information about yourself
Respect the legal framework of your jurisdiction
Report suspicious, abusive, or illegal behaviour
Use the platform only for its intended purpose
5.2 You Must NOT
Use the platform if under 18 years of age
Harass, threaten, stalk, or abuse other users
Send sexually explicit content or unsolicited sexual messages
Solicit or offer money in jurisdictions where donor compensation is illegal
Post false, misleading, or deceptive information
Impersonate another person or misrepresent your identity
Use the platform for commercial purposes, advertising, or solicitation
Attempt to extract data, scrape profiles, or reverse-engineer the platform
Circumvent security measures, bans, or restrictions
Use the platform to facilitate any illegal activity
Share another user's private information without their consent
Use automated tools, bots, or scripts to interact with the platform
6. Content and Communications
You retain ownership of content you post, but grant Nestora a license to store, display, and transmit it as necessary to provide the Service
Messages are text-only; no image sharing is permitted
Content is subject to automated safety filtering (profanity, compensation language in restricted regions)
We may review reported content and take action including removal or account suspension
We are not obligated to monitor all content but reserve the right to do so
7. Health Information Disclaimer
All health information on Nestora is self-reported and UNVERIFIED. Nestora does not conduct background checks, medical screenings, genetic tests, or any form of health verification. Users must not rely on self-reported information for any medical or reproductive decisions.
Nestora expressly disclaims any responsibility for:
The accuracy or truthfulness of any health information shared by users
Any genetic, medical, or health conditions of any user
Any health outcomes resulting from interactions facilitated through the platform
Any conception, pregnancy, or birth outcomes
The transmission of any infectious disease or genetic condition
8. Regional Legal Compliance
Sperm donation and related activities are regulated differently across jurisdictions. Nestora provides general information about legal modes (commercial, altruistic, restricted) but this is informational only and does not constitute legal advice.
Users are solely responsible for understanding and complying with their local laws
Nestora may restrict certain features in jurisdictions where activities are prohibited
The platform's content filters (e.g., blocking compensation language in altruistic jurisdictions) are best-effort safety measures, not legal guarantees
Regional disclaimers shown in the app are general information, not legal advice
9. Safety and Enforcement
Users who violate these Terms may have their accounts restricted, suspended, or permanently banned
Accounts blocked by 3 or more users may be automatically restricted
We cooperate with law enforcement when legally required
We maintain audit trails for safety and legal compliance purposes
Banned users may not create new accounts; ban evasion will result in immediate re-ban
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Nestora is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
We do not warrant that the Service will be uninterrupted, secure, or error-free
We are not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Service
We are not liable for any actions, decisions, or outcomes resulting from interactions between users
We are not liable for any reproductive, medical, legal, or personal outcomes arising from use of the platform
We are not liable for any user's misrepresentation, fraud, or harmful behaviour
Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim (if any)
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Nestora, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
Your use of the Service
Your violation of these Terms
Your violation of any applicable law
Any arrangement, agreement, or interaction with another user
Any content you post or transmit through the Service
Any dispute between you and another user
12. Intellectual Property
The Nestora name, logo, and platform design are our intellectual property
You may not copy, modify, or distribute any part of the Service without permission
User-generated content remains yours, but you grant us a non-exclusive license to use it for providing the Service
13. Account Termination
You may delete your account at any time through the app
We may suspend or terminate your account for violations of these Terms
Upon termination, your profile is removed and data is handled per our Privacy Policy
Sections that by their nature should survive termination (liability, indemnification, dispute resolution) will survive
14. Dispute Resolution
These Terms are governed by the laws of the State of Victoria, Australia
Any disputes shall be resolved first through good-faith negotiation
If negotiation fails, disputes shall be submitted to mediation before any legal proceedings
Legal proceedings shall be brought in the courts of Victoria, Australia
Nothing in these Terms limits your statutory consumer rights under applicable law
15. Disclaimers Specific to Reproductive Arrangements
Nestora provides a communication channel only. We emphasise the following:
No vetting: We do not screen, interview, or verify users beyond phone number verification
No medical oversight: We do not provide or supervise any medical procedures
No legal documentation: We do not create, review, or facilitate donor agreements, co-parenting agreements, or any legal documents
No guarantees: We make no representations about the suitability, reliability, or intentions of any user
No outcomes: We accept no responsibility for any reproductive, familial, or personal outcomes
Donor rights: Legal rights and obligations of donors vary significantly by jurisdiction. Users must obtain independent legal advice regarding parental rights, donor anonymity, child support obligations, and related matters
Child welfare: Users acknowledge that in many jurisdictions, donor-conceived children have legal rights to know their biological origins. Users should consider this when making arrangements
16. Third-Party Services
The Service uses third-party providers (AWS, Twilio). We are not responsible for the availability, security, or practices of third-party services. Your use of the Service is also subject to Apple's App Store Terms of Service.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nestora regarding the Service.
